Convicted Joshlin Smith kidnappers seek to appeal life sentences
The legal battle surrounding the kidnapping and trafficking of six-year-old Joshlin Smith continues as the convicted trio Racquel “Kelly” Smith, Jacquen Appollis, and Steveno van Rhyn filed notices to appeal their convictions and sentences in the High Court in Cape Town.
On May 29, 2025, the Western Cape High Court, sitting in Saldanha Bay, sentenced the three to life imprisonment for human trafficking and 10 years for kidnapping, following a high-profile trial that shocked the nation.
Judge Nathan Erasmus handed down the sentences, emphasizing the severity of the crimes committed against the vulnerable child.

However, the defense has now signaled its intent to challenge both the convictions and the sentences, with affidavits from both sides expected to be submitted before an appeal hearing date is set.
Senior State Prosecutor Advocate Aradhana Heeramun expressed confidence in the prosecution’s case, stating, “We are fully prepared to oppose these appeals at every level, including the Supreme Court of Appeal if necessary.”
The National Prosecuting Authority (NPA) confirmed receipt of the appeal notices and is gearing up for the next phase of the legal process.
Meanwhile, a separate inquiry into granting indemnity to section 204 witness Lourentia Lombaard is expected to unfold, adding another layer to this complex case.
